Premium Subscription Agreement

Premium subscription terms: ranking eligibility, billing, renewal, cancellation and withdrawal rights.

1. Parties and purpose
ObraSoft Tecnologia da Informação LTDA. (trading as "Hottest Car List"), registered under Brazilian company number (CNPJ) 13.342.101/0001-92, with address at Avenida Engenheiro Luis Carlos Berrini, 1140, CJ 72, Cidade Monções, São Paulo/SP, Brazil, operates the website https://hottestcarlist.com and the services offered on it. Contact: legal@hottestcarlist.com.
This agreement governs the subscription to paid plans that make a registered vehicle eligible for the weekly Hottest Car List vote and increase photo and video limits according to the chosen plan.
The subscription is tied to a specific vehicle in your garage.
2. Plans and prices
Available plans, their limits and prices are shown at the time of purchase, in the user's garage. The free plan requires no payment and does not grant ranking eligibility.
Prices are charged in US dollars and may be subject to currency conversion and charges set by your card issuer.
3. Purchase and payment
The order is sold by the company and processed through Stripe, our payment processor. The company issues the invoice, collects the applicable taxes and provides support regarding charges.
Premium access is released once the provider confirms the payment.
4. Automatic renewal
The subscription is monthly and renews automatically at the end of each cycle, at the price then in force, until cancelled.
Price changes will be announced at least 30 days in advance and apply only to subsequent cycles.
5. Cancellation
You may cancel at any time, with no penalty, through the “My account” area (billing portal) or by contacting our support.
After cancellation, the vehicle remains premium and eligible for voting until the end of the period already paid for, with no further charge.
6. Upgrades and downgrades
Switching plans takes effect in the next billing cycle. Until then, the limits and price of the current plan remain in place.
7. Payment failure
If a charge fails, the subscription becomes past due and the vehicle remains eligible while the provider retries. If the failure persists, the subscription is terminated and the vehicle is no longer eligible for the ranking.
8. Right of withdrawal
Under article 49 of the Brazilian Consumer Protection Code, you may withdraw from the purchase within 7 calendar days of the transaction, with a full refund of the amounts paid.
9. Subscriber obligations
Keep the vehicle content compliant with the Terms of Use; do not manipulate the vote; keep billing details up to date.
Removal of the vehicle for breach of the rules does not give rise to a pro-rata refund where a serious infringement is established.
10. Term, termination and jurisdiction
The agreement runs for an indefinite term while a subscription is active. It may be terminated by either party as described above.
Brazilian law applies, with jurisdiction in the courts of the consumer's domicile.
