This document was drafted in English. Translations are provided for convenience; in case of divergence, the English version prevails.

1. Identification and acceptance

ObraSoft Tecnologia da Informação LTDA. (trading as "Hottest Car List"), registered under Brazilian company number (CNPJ) 13.342.101/0001-92, with address at Avenida Engenheiro Luis Carlos Berrini, 1140, CJ 72, Cidade Monções, São Paulo/SP, Brazil, operates the website https://hottestcarlist.com and the services offered on it. Contact: legal@hottestcarlist.com.

By creating an account, ticking the acceptance box or continuing to use the site, you declare that you have read and fully agree to these Terms of Use, to the Privacy Policy and, if you purchase a paid plan, to the Premium Subscription Agreement.

You declare that you are at least 18 years old or duly represented and, if acting on behalf of a legal entity, that you have the authority to bind it to these Terms.

2. Description of the service

Hottest Car List is a digital subscription service (software as a service) in which owners publish and maintain online profiles of special and supercar vehicles, with photo and video hosting, editorial curation, promotion tools and catalogue highlighting. The public may rate published profiles, and each week the site organises an editorial list of the world's 100 hottest cars, plus a comparison between countries.

The paid subscription grants access to software features (more photos, more videos, editorial highlighting and eligibility for the weekly list). It is not a sweepstake, lottery, bet, prize contest, investment or any form of cash payout: no financial prize is offered, and a position in the list is only editorial recognition, with no economic value.

Cars on the free plan may be registered and displayed; eligibility for the weekly list requires an active subscription, as described in the Premium Subscription Agreement.

3. Registration and account responsibility

You must provide true, complete and up-to-date information. You are responsible for keeping your access credentials confidential and for all activity carried out with your account.

You must immediately report any unauthorised use of your account to legal@hottestcarlist.com.

4. User content

Photos, videos, texts, comments and other materials you submit are your sole responsibility. You declare that you hold all necessary rights over the content, including permission to use the image of any person portrayed.

By publishing content, you grant Hottest Car List a non-exclusive, worldwide, royalty-free licence to store, reproduce, technically adapt, display and publish that content on the site, on our official social media channels (such as Instagram, Facebook, TikTok and YouTube) and in our promotional materials, solely to operate and promote the service, for as long as the content remains published.

We may remove, hide or moderate content that violates the law, third-party rights or these Terms, including through automatic offensive-language filters.

Notices of copyright or image-rights infringement may be sent to legal@hottestcarlist.com, identifying the material and the right claimed. Repeat infringements may lead to account termination.

5. Voting rules and integrity

Voting is personal and restricted to authenticated users. Creating multiple accounts, using automation or bots, buying votes, fraudulent incentives or any device to manipulate the ranking is prohibited.

Suspicious votes may be disregarded and the accounts involved suspended, with no right to a refund where fraud is established.

6. Prohibited use

You may not use the service for unlawful purposes, fraud, spam, hate speech, sexual content, intellectual property infringement, reverse engineering, data scraping, intrusion attempts, malware distribution, unauthorised security testing or circumvention of technical limitations.

Reselling, redistributing or sublicensing the service or its content without written authorisation is also prohibited.

7. Intellectual property

The software, design, trademarks, logos, texts and structure of Hottest Car List belong to the company or its licensors. We grant you a limited, non-exclusive, revocable and non-transferable right to use the service according to the plan you purchased.

8. Payments and payment processing

Sales are made directly by the company, which is the seller of record. Card processing is carried out by Stripe, our payment processor; we never store or have access to your full card details.

Billing, taxes, invoicing and cancellation conditions follow the Premium Subscription Agreement and our Cancellation & Right of Withdrawal policy. Charges appear on your statement under the name Hottest Car List.

9. Availability and warranties

We use reasonable efforts to keep the service available, but we do not guarantee uninterrupted, error-free operation or immunity from third-party outages (hosting, payment providers, networks).

To the maximum extent permitted by law, the service is provided “as is”, without implied warranties of fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate access in the event of a material breach of these Terms, non-payment, fraud or security risk, or repeated breaches of the content and voting rules.

You may close your account at any time. Once the account is closed, published content may be removed, subject to statutory record-retention periods.

11. Limitation of liability

To the extent permitted by Brazilian law, our aggregate liability for any claims related to the service is limited to the amount you paid in the 12 months preceding the triggering event.

We are not liable for indirect damages, lost profits, loss of data or loss of opportunity. Nothing in these Terms excludes liabilities that cannot be waived by law, including those set out in the Brazilian Consumer Protection Code, wilful misconduct, death or personal injury.

12. Indemnity

You agree to indemnify the company against third-party claims arising from the content you publish, from unlawful use of the service or from any breach of these Terms.

13. Changes

These Terms may be updated. Material changes will be announced on the site and, where applicable, will require renewed acceptance before continued use. The version in force is always shown at the top of this page.

14. Governing law and jurisdiction

These Terms are governed by Brazilian law, including Law No. 12,965/2014 (Brazilian Internet Civil Framework), Law No. 13,709/2018 (LGPD) and Law No. 8,078/1990 (Consumer Protection Code).

Disputes shall be settled in the courts of the consumer's domicile, as provided by consumer legislation.
